Terms and Conditions
INTRODUCTION
These General Terms and Conditions define the rights and obligations between the vehicle lessor (hereinafter: the “Lessor”) and the service user (hereinafter: the “User”). The Lessor (a rent-a-car agency operating within the company “BIP Hotels” LLC) and the User conclude a Vehicle Rental Agreement upon renting a vehicle.
By signing the Vehicle Rental Agreement, the User accepts the rental conditions and agrees to the General Terms and Conditions of the Lessor. The individual listed in the Agreement as the driver signs the Rental Agreement and the Vehicle Condition Report, thereby accepting responsibility for compliance with all rental conditions and general terms of vehicle use.
1. CONTRACT
1.1 Rental Agreement
The Rental Agreement, signed by the User and the Lessor prior to vehicle pickup, contains all essential information regarding the vehicle, the User’s details, pickup and return locations, date and time of pickup and return, rental price, method of payment, list of additional equipment and services, included insurance, deposit amount, and driver information.
By signing the Agreement, the User accepts all General Rental Terms displayed at the Lessor’s business premises and official website. By validating the Agreement, the Lessor authorizes the use of the vehicle by the person listed as the User.
The Agreement terminates when the User returns the rented vehicle to the agreed location and hands over the keys and documentation to the Lessor or an authorized representative. In the event of a traffic accident, the Agreement terminates once the User submits a complete police report.
1.2 Vehicle Condition Report
Upon vehicle pickup and return, the User and the Lessor record all relevant information regarding the vehicle’s condition, including mileage, fuel level, equipment, and any existing or newly incurred damage, on a designated form or within the Agreement.
1.3 Price Lists
Vehicle Rental Price List
An internal document of the Lessor specifying rental prices by vehicle category and rental duration.
Damage Price List
An internal document defining charges for damages not covered by insurance.
Additional Services and Insurance Price List
An internal document defining prices for optional insurance packages, equipment, and additional services available to the User.
2. GENERAL TERMS OF USE
The minimum driver age is 22 years.
Upon vehicle pickup, the User must present a valid identification document (ID card or passport) and a credit card for deposit preauthorization.
By purchasing an appropriate insurance package, the deposit amount may be reduced or waived. Regardless of the selected insurance, card data must be recorded for potential additional charges such as traffic fines, damages, or costs described in Sections 3, 5, and 6.
Payments may be made in advance by cash, card, or bank transfer.
All prices are stated in EUR.
Drivers must hold a valid driving license for at least two (2) years. Drivers aged 22–25 are subject to an additional young driver fee.
2.1 Deposit
A deposit is mandatory and must be made using a credit card issued in the name of the reservation holder.
The deposit amount depends on the vehicle category.
The deposit is refunded upon vehicle return, provided no damage has occurred to the vehicle interior or exterior and all contractual obligations have been fulfilled.
2.2 Rental Duration
The minimum rental period is 24 hours. Early returns do not entitle the User to a refund.
The pickup and return times must match those stated in the reservation, with a tolerance of 30 minutes. After this period, an additional rental day is charged.
Rental extensions require prior approval from the Lessor.
Early termination of the rental is possible with prior notice, however the Lessor reserves the right to charge a penalty of up to two rental days.
Long-term rentals are subject to special agreements.
2.3 Mileage
Unlimited mileage applies within Montenegro.
For rentals shorter than four days involving cross-border travel, mileage is limited to 1,000 km. Exceeding this limit is charged at €0.02 per kilometer.
Mileage conditions for long-term rentals are agreed separately.
2.4 Reservation, Pickup, and Return
Vehicles are picked up and returned at the Lessor’s business locations, also as refill cost of 15,00 euros.
Reservations may be modified free of charge if the Lessor is notified at least 24 hours before the rental start.
Rental extensions must be requested at least 24 hours before expiration.
Cancellations made at least 24 hours in advance are free of charge.
VAT is included in the rental price.
The rental price includes mandatory third-party liability insurance (TPL) and basic collision damage waiver (CDW), subject to the terms of this Agreement.
Leaving the territory of Montenegro without prior written approval voids all insurance coverage.
Vehicles must be returned with the same fuel level as at pickup; refueling and service fees apply otherwise.
Optional services and equipment are charged additionally.
The Lessor reserves the right to substitute the reserved vehicle with another of the same or higher class.
Failure to collect the vehicle or cancellation within 24 hours results in a charge equal to one rental day (minimum €30).
Failure to return the vehicle on the agreed date without notice may result in the vehicle being reported as unlawfully retained and may trigger legal proceedings.
Traffic fines and parking penalties are the sole responsibility of the User.
Loss of keys or documents is charged €500.
The rental period ends when the vehicle, keys, and documents are returned to the Lessor.
Early return does not entitle the User to a refund.
Vehicle condition is inspected upon return, and a damage report is completed if necessary.
One-way rentals and off-site deliveries are available for an additional fee.
3. INSURANCE AND LIABILITY
The deductible represents the maximum amount for which the User is liable in case of damage.
The amount depends on the vehicle category and selected insurance package.
Insurance options include:
- Damage coverage (excess) – The amount up to which the client shall be held liable (and not exceeding that amount) if the incurred damage falls within the type of coverage (CDW, TP, WUG) included in the selected insurance package.CDW (Collision Damage Waiver) – limits liability for vehicle damage
- Deposit - The deposit is an amount corresponding to the Damage Coverage (excess). A credit card is required to preauthorize the deposit. For car rental, the card must be valid for at least six months after the end of the rental agreement. A debit card is sufficient for the ‘Full Insurance’ package, whereas a credit card is mandatory for the ‘Medium Insurance’ package.
- TP (Theft Protection) – covers theft of the vehicle
- WUG (Wheels, Undercarriage, Glass) – covers wheels, tires, undercarriage, and glass
- PAI (Personal Accident Insurance) – covers driver and passenger injuries
- Vehicle Interior Insurance - insurance covering damages occurring inside the vehicle.
Insurance does not cover loss of keys, documents, improper fueling, interior damage, or damage caused by negligence.
A police report is mandatory for all insurance claims.
4. PROCEDURE IN CASE OF ACCIDENT, DAMAGE, OR THEFT
In the event of damage or theft, the User must:
- Notify the police and the Lessor immediately
• Remain at the scene unless medical assistance is required
• Record details of all parties involved
• Complete a damage report
• Provide a written statement describing the incident
Failure to provide a police report voids all insurance coverage.
5. ADDITIONAL CONDITIONS OF USE
The User must properly maintain the vehicle and notify the Lessor of any malfunction or damage.
Unauthorized repairs are prohibited.
The User confirms receipt of a technically sound vehicle and must immediately report any defects.
The Lessor reimburses approved maintenance costs upon presentation of valid receipts.
Unauthorized repairs or replacements will not be reimbursed.
5.1 Restrictions
The rented vehicle must not be used:
- Under the influence of alcohol, sedatives, narcotics, sleeping pills, or other medications.
- For illegal purposes (criminal or misdemeanor acts, customs violations, or other offenses).
- For paid transport of passengers or goods.
- For any competitions, speed tests, or races.
- To tow or pull other vehicles, trailers, or any objects.
- When the vehicle is not in drivable condition.
- For driver training.
- For transporting animals without prior approval from the lessor.
- Contrary to the manufacturer’s specifications or markings in the vehicle registration documents.
- Contrary to traffic regulations in the country of registration or the country where the vehicle is being used.
- By a person whose driving license has been revoked or who does not possess a valid license.
- Outside marked public roads.
- By an unauthorized person (someone not listed in the Rental Agreement).
- In the territory of Kosovo and Metohija without prior consent from the lessor.
In all the above cases, insurance is void, and the full cost of damage or theft will be charged to the user.
6. MISCELLANEOUS
6.1. Traffic fines; Fuel; Vehicle cleaning; Pick-up or drop-off outside business hours; Additional services; Handling of damages:
Traffic fines:
Traffic and municipal fines incurred during the rental period due to violations of traffic or other regulations are the sole responsibility of the User, who must cover all costs arising from such obligations. If the User fails to settle these obligations within the prescribed deadline, an administrative fee will be charged in accordance with the current price list.
Fuel:
The User pays for consumed fuel. Fuel is not included in the rental price. If the User returns the vehicle with less fuel than at the time of pick-up, the difference will be charged according to the current price list, along with any additional refueling costs.
Vehicle cleaning:
If the User returns a vehicle that requires additional or special cleaning (deep cleaning), the cost will be charged according to the current price list. Smoking in the vehicle is prohibited. Any violation of this rule may be charged to the User according to the current price list.
Pick-up or drop-off outside business hours:
Pick-up, drop-off, or vehicle issuance outside business hours is subject to an additional charge according to the current price list.
Additional services:
Additional services are optional and are charged according to the User’s selection and the current price list.
Handling of damages:
Any damage caused by the User to the vehicle that is not covered by optional additional insurance will be charged according to the predefined rates and the category of the rented vehicle, using the deposit reserved on the User’s credit card, up to the maximum liability limit. An administrative fee for processing the damage event will also apply according to the current price list.
The User must present all documents provided by the police or other parties (police report, signed European Accident Statement with acknowledgment of fault, alcohol test report, etc.) and must also complete an accident report at the Lessor’s office.
6.2. Post-rental card charges:
The payment card may be additionally and retroactively charged, with notification to the User by email including supporting evidence, in the following cases:
- Parking fines issued and received by the Lessor after the rental period
- Traffic violation fines issued during the rental period and received by the Lessor later
- Vehicle damages or return with less fuel than at pick-up, discovered later
- Damages discovered immediately after vehicle return during cleaning that were not visible during the initial inspection
6.3. Payment:
The User is required to pay the invoice upon vehicle pick-up, except in the case of long-term rentals, where terms are defined in a separate business-technical cooperation agreement. The amount is payable according to the rate in effect at the time of signing the Rental Agreement. Late payments incur statutory interest and reminder costs.
Vehicles are rented at a daily rate according to the current price list, where one day is defined as a 24-hour period from the time of signing the Rental Agreement and vehicle handover.
By signing the Rental Agreement, the User confirms agreement with the general terms of vehicle rental of the Lessor and consents to the Lessor charging their payment card or pre-authorized deposit for all costs not included in the basic rental, including additional services or costs incurred under the general rental terms (damages, loss of keys or documents, accompanying and additional equipment, missing fuel, unpaid fines during the rental period, and administrative or other services of the Lessor according to the current price list).
The final settlement and payment of the rental is made upon vehicle return (drop-off) along with accompanying documents and keys, after checking the vehicle condition for any damages, fuel level, mileage, cleanliness, and accompanying/additional equipment. The Lessor reserves the right to charge the User for any additional costs incurred during the rental period.
Payment of the rental and additional services can be made with any payment card (Visa or MasterCard), except American Express and Amex, which are not accepted. Payment may also be made in cash.
Pre-authorization of funds is only possible on credit cards issued in the name of the reservation holder, and the card must be physically present at the time of vehicle rental. American Express and Amex are not accepted for deposits.
6.4. Documents, accompanying and additional equipment:
All vehicles are rented with the necessary documents, which are checked by both the User and Lessor at the time of pick-up.
The User is responsible for the documents, which must be carried with them along with the vehicle keys and not left inside the vehicle.
If the User receives additional equipment when signing the rental agreement, they are responsible for both the additional and accompanying equipment in the vehicle.
In case of loss of documents, keys, registration plates, or any additional equipment, charges will be applied according to the current price list.
6.5. Right to inspection, contract termination, and GPS tracking:
All employees of the Lessor or other authorized persons have the right to monitor vehicle usage at any time if there are indications that the vehicle is not being used in accordance with the Rental Agreement and General Terms of Use. They may demand the return of the vehicle and terminate the rental agreement at any time and place.
The Lessor reserves the right to track the vehicle’s movement via GPS.
6.6. Replacement vehicle:
This service provides a replacement vehicle in case of breakdown, traffic accident, or other situations causing vehicle immobility or unusability.
In the event of a breakdown, traffic accident, or other situation causing immobility or inability to use the vehicle, the Lessor will provide the User with a replacement vehicle within a reasonable time.
All rights and obligations of the User arising from the original Rental Agreement and General Terms of Use apply to the replacement vehicle.
6.7. Signatory of the Agreement:
By signing, the User unconditionally accepts the terms of vehicle use of the Lessor and guarantees the accuracy of all provided information.
The User is responsible for the rented vehicle for the entire duration of the Rental Agreement, regardless of whether the vehicle is being driven or parked.
If the User is a legal entity, they may, with prior written consent from the Lessor, allow their employees to use the rented vehicle, provided they meet the rental requirements. The User is obliged to inform other users of the vehicle of all General Rental Terms of the Lessor. The User is fully responsible for the actions of other users and must fulfill all contractual obligations and cover any additional costs caused by other users.
7. DATA PROTECTION
Payment card information is processed securely via certified payment systems. The Lessor does not store card data.
